In other cases, it makes sense to purchase a “structured settlement,” which is designed to make payments over time and to take advantage of certain favored federal tax treatment. In order to use this option, however, specific steps must be taken in negotiating the terms of the settlement agreement. Otherwise, the favorable tax treatment can be lost.
Where the injured person is a minor, a probate court will have to approve any settlement proposal. The terms of the settlement must be in the best interests of the child, and the court will ensure that funds are set aside to take care of the child in the future.
