What is Wrongful Death?

Transcript:

Hey, Brian, what does the term wrongful death mean. Wrongful death? Pretty straightforward. Wrongful death is a term used for when somebody dies as the result of someone else's negligence. Negligence means the failure to use ordinary care under the circumstances. So, if someone fails to use ordinary care under the circumstances and as a result, someone else dies, the person who died, their family has the right to bring a wrongful death lawsuit against the person who failed to act reasonably. In the medical context, if a doctor or a nurse or a medical facility or some other medical personnel fails to use ordinary care under the circumstances, and as a result, someone dies, one of the things the decedent's family can do is bring a lawsuit to try to hold the person who failed to act reasonably accountable for the injuries the family suffered. That's a wrongful death case.
